Sales Policy: Terms and Conditions

This Sales Policy applies only to the original purchaser of the item (“Customer,” “Purchaser,” “you”) and is not transferable to any other party.

By completing a purchase, you acknowledge and agree to the terms below.


 

1) Lifetime Jewelry Warranty

Hung Phat (“Store”) provides a Lifetime Jewelry Warranty that applies to the jewelry item only. This warranty covers manufacturing defects in materials and workmanship under normal wear and tear, as determined by the Store.

If a manufacturing defect is confirmed after inspection, the Store will repair the jewelry at no charge.

What This Warranty Does Not Cover

This warranty does not cover:

  • Diamonds or gemstones of any kind, including loss, chipping, cracking, or damage

  • Damage caused by accident, misuse, abuse, or improper care

  • Normal wear that is not related to a manufacturing defect

  • Loss or theft

Any unauthorized repair, resizing, alteration, or modification will void this warranty.

Warranty Limitations

This warranty is non-transferable and applies only to the original purchaser.

 


 

2) Exchanges and No Refunds

All items are sold “AS IS” and are non-refundable. All sales are final.

The Store will determine, in its sole discretion, the condition of any item presented for exchange.

Exchange Eligibility

Exchanges are permitted within 7 days of the sales receipt date, provided that:

  • The original receipt is presented, and

  • The item is returned new, unworn, unmodified, and in its original condition

All exchanges must be for an item of equal or greater value than the original purchase.

If the exchanged item is of lesser value, no refund or credit will be issued for the price difference.

Exchange Exclusions

Exchanges are not permitted for:

  • Loose diamonds or gemstones

  • 24K jewelry

  • Designer Brand jewelry

  • Any resized, personalized, customized, or engraved items

 


 

3) Diamond Upgrade Policy

Information regarding diamond upgrades is available upon request. Customers should inquire with a Client Advisor for further details.

 


 

4) Miscellaneous Terms

These Terms and Conditions govern all purchases and supersede any prior oral or written statements.

The Store shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to the purchase, repair, alteration, or setting of any jewelry item.

Governing Law and Venue:
Any dispute, claim, or legal proceeding arising out of or relating to a purchase or this Sales Policy shall be governed by the laws of the State of California. All such disputes shall be brought exclusively in the state courts located in Santa Clara County, California, or, if federal jurisdiction applies, in the federal courts located within Santa Clara County, California. By completing a purchase, the Customer consents to the personal jurisdiction and venue of these courts.
