1. 1. OUR COMPANY
Hung Phat USA Diamonds & Jewelry is a family-owned and operated online diamond and jewelry retailer specializing in 18k gold and platinum pieces, GIA/EGL/IGI certified diamonds, custom-designed jewelry, and fine watches. Our affiliated company, Trans Fine Jewelry Inc., doing business as Hung Phat USA Diamonds & Jewelry (“Trans Fine”), is a California corporation with its principal showroom located at 1111 Story Road, Showroom #1063, San Jose, CA 95122. Trans Fine has proudly served the Bay Area community since 1982.
2. 2. REGISTRATION
You may browse our Website without registering. To access certain features or make purchases, you must create an account by providing your full name, email, phone number, company name, billing and shipping address, and a password. You are responsible for keeping your password confidential and for all activity on your account. Hung Phat USA will never request your password by email or through any site other than www.hungphatusa.com. If you suspect unauthorized use, change your password immediately and notify us. All registration information must be truthful and complete. We may suspend or cancel your account without notice if information is inaccurate, if you violate these Terms, or if fraud or illegal activity is suspected, which may also be reported to law enforcement.
3. 3. PRODUCT AVAILABILITY AND PRICING
If an item is on back order, please call us for availability. Occasionally, products may sell out before our Website updates; if so, we will contact you with alternatives.
While we strive for accuracy, pricing or data errors may occur. We reserve the right to correct them and are not required to honor incorrect prices. If an error is found after shipping, you agree to return the item or pay the difference.

4. 4. PURCHASES
All purchases must be made in U.S. Dollars, either online or by calling 1-408-299-0988. We accept Visa, MasterCard, American Express, PayPal, and wire transfers. International customers are responsible for any local taxes or duties.
For installment orders, a deposit is required, and all payments must be completed within 4 weeks of the order date. Failure to pay, or initiating a chargeback, may result in order cancellation, forfeiture of payments made, and collection of outstanding balances, which may also be reported to credit bureaus.
5. 5. COMPARISON PURCHASING
To keep prices low, we do not allow “comparison purchasing,” which is buying multiple items to keep only one and return the rest. This creates unnecessary costs. If you’d like help confirming the quality of a piece before purchasing, please contact our customer service at 1-408-299-0988.
6. 6. DIAMOND CERTIFICATES
All loose diamonds are shipped with their official grading report (certificate) from a recognized gemological laboratory. Because these reports are costly to replace, any diamond return must include the original certificate. Returns without the certificate will incur a $250 replacement fee.
7. 7. DIAMOND UPGRADES
If you wish to upgrade to a larger diamond, we accept trade-ins and will credit up to 70% of the original purchase price toward your new diamond.
